New Rule Allows for Concurrent Filing of I-140 and I-485


A 7/31/02 INS interim rule, which took effect on the same day, provides that Form I-140 (Immigrant Petition for Alien Worker) and Form I-485 (Application for Adjustment of Status) may now be filed concurrently when a visa number is immediately available. In addition, alien beneficiaries with I-140 petitions pending on 7/31/02 may now file the I-485 and associated forms. The rule allows the alien worker to apply for employment authorization and advance parole while the I-485 is pending. To view the Federal Register Rule, click on the "PDF file" link (PDF file).
